JUSTICE SANJAY PRIYA ORAL ORDER 5/ 22-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The Petitioners seek bail in Darbhanga-Sitamarhi G.R.P. P.S. Case No.83 of 2016 instituted for the offence under Section(s) 370 of the Indian Penal Code and Section 16 of Bounded Labour System (Abolition) Act.

It has been submitted that one of the accused, Gagan Mukhiya, with similar allegation, has been granted bail by this Court by order dated 06.02.2017 passed in Cr. Misc. No.3008 of 2017.

As per written report, the accused persons were taking ten children to Pune for human trafficking through train. On

Patna High Court Cr.Misc. No.55302 of 2016 (5) dt.22-03-2017 2/2 confidential information, the police arrived there and released total children from custody of the accused and arrested four persons including the petitioner.

The Sessions Judge has mentioned in the impugned order that it is mentioned in para 32, 33, 34, 36, 37, 43 of the case diary that child were accompanying the accused for the purpose of labour work. The petitioner is said to be in custody since 19.10.2016.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rail, Samastipur, in connection with DarbhangaSitamarhi GRP P.S. Case No.83 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) JA/- U T
