The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 448, 504, 506, 354, 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and allegation of firing is against Abhishek but no one was injured, it is next submitted that police after investigation came to a considered conclusion that the petitioners have been falsely implicated, as

No.21866 of 2023(2) dt.05-07-2023 2/2 such, final form in their favour was submitted but the learned Court, in a mechanical manner, differing with the police report took cognizance, it is further submitted that when one investigating agency, after threadbare investigation, has found the case to be false, it would not be prudent to send the petitioners to jail at this stage.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Parasbigha P.S. Case No. 170 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) HarshPandey/- U T
