The petitioner seeks bail in a case instituted under Sections 366, 376 and 506 of the Indian Penal Code. The prosecution case, in brief, is that due to poverty of the victim, the petitioner sexually abused her and told her to flee away and on being protested by the victim, the petitioner threatened her for dire consequence. Thereafter the petitioner brought her at Ahmedabad (Gujrat), where he kept her in a room for one month and made sexual intercourse with her and on 07.07.2016 the petitioner fled away leaving her. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.08.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of

There was a consented physical relationship between the petitioner and the victim. Later on, due to some petty dispute, the present case has been instituted against the petitioner. The petitioner is aged 60 years old. On behalf of the state it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Begusarai, in connection with Dandari P.S.
