JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-04-2019 The petitioner seeks regular bail in connection with Agamkuan P.S. Case No. 632 of 2017, giving rise to Special (POCSO) Case No. 181 of 2017 for the offences punishable under Sections 377/34 of the Indian Penal Code and Section 3⁄4 of POCSO Act.
Perused the report submitted by the learned 1st Additional Sessions Judge-cum- Special Judge (POCSO), Patna dated 13.03.2019 wherein it has been submitted that the case is pending for prosecution evidence and if both parties cooperate, the trial will be concluded within five months. At this juncture, the learned counsel for the petitioner submits that the petitioner be granted liberty to approach this Court again after a period of six months from today, however, in
Patna High Court CR. MISC. No.75711 of 2018(4) dt.17-04-2019 2/2 the meantime, the trial court be directed to conclude the trial. Having regard to the facts and circumstances of the case, I direct the learned court of st Additional Sessions Judgecum- Special Judge (POCSO), Patna to expedite the proceedings of Special (POCSO) Case No. 181 of 2017 arising out of Agamkuan P.S. Case No. 632 of 2017 and conclude the trial preferably within a period of six months from today. The present bail petition is disposed of as withdrawn, however, with liberty to the petitioner to move this Court after expiry of six months, in case there is no progress in the trial.
