2. Petitioner seeks bail, who is in custody since 25.11.2023, in connection with Buxar (M) P.S. Case No. 489 of 2023, F.I.R. dated 15.11.2023 registered for the offences punishable under Sections 341, 323, 324, 307, 302, 354(B), 379, 504, 506/34 of the Indian Penal Code.
3. Earlier the prayer for bail of the petitioner was rejected vide order dated 26.07.2024 passed in Cr. Misc. No. 25101 of 2024. Thereafter, the petitioner again moved before this Court in Cr. Misc. No. 15198 of 2025 which was dismissed as withdrawn vide order dated 05.03.2025 with liberty to the petitioner to move a fresh application before the learned Court

4. Learned counsel for the petitioner submits that the petitioner is in custody since 25.11.2023 and the trial is not in progress.
5. Vide order dated 04.04.2025 a report was called for with regard to the stage of the trial. Report dated 11.04.2025 of the learned Trial Court reveals that out of eight chargesheeted witnesses, two witnesses have been examined and the case is pending for examination of rest six witnesses.
6. Learned APP for the State, on the other hand, vehemently opposed the prayer for bail of the petitioner and submits that from perusal of the F.I.R. it appears that there is direct and specific allegation against the petitioner that he inflicted Khanti blow upon the head of the informant's brother Jyoti Prakash Ram and he died during his treatment at Varanasi and the postmortem report of the deceased also supports the allegation as alleged in the F.I.R.

Considering the aforesaid facts and circumstances of the case, nature of allegation as alleged in the F.I.R. as well as in view of the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Buxar (M) P.S. Case No. 489 of 2023 pending in the Court of
Patna High Court CR. MISC. No.20972 of 2025(3) dt.09-05-2025 3/3 learned District & Sessions Judge-VIII, Buxar
8. Prayer is refused.
9. However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Ibrar//- U
