JUSTICE SHIVAJI PANDEY ORAL ORDER 24-07-2020 Heard Mr. Bhola Prasad, learned counsel for the petitioner and Ms. Renu Kumar, counsel for the State. In this case, the petitioners are apprehending their arrest in connection with Adadpur P.S. Case No. 3 of 2020 registered for offences under sections 379, 461 of the Indian Penal Code.

In the present case, the police has recovered the theft articles of the Informant from the house of the present petitioners.

The petitioner no.1 has got criminal antecedent of four criminal cases whereas the petitioner no.2 has criminal antecedent of two cases as has been stated in paragraph no.3 of

Patna High Court CR. MISC. No.20928 of 2020(2) dt.24-07-2020 2/2 the present petition.

Looking to the entire facts and circumstances of the case as also there being criminal antecedent of the petitioners, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.

Accordingly, the prayer for bail of both the petitioners, above named, is rejected.

If the petitioners surrender before the court below within a period of eight weeks from today and make a prayer for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law preferably on the same day of surrender of the petitioners.
