1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 324, 325 and 307 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that in context of returning Rs. 3 lakhs taken by Shyam Kishore Singh for the registry of land in 2020, an altercation took place in which it is alleged that 11 named accused persons including the petitioner came variously armed and assaulted the informant and his wife. It is next alleged that Krishna Mohan Singh assaulted the informant with spade causing injury on left leg, thereafter petitioner assaulted the informant with Tangi
Patna High Court CR. MISC. No.24850 of 2023(2) dt.19-07-2023 2/2 causing injury on head, Radhey Shyam also assaulted the informant with spade causing injury on his right leg and thereafter Uma Shankar assaulted the wife of the informant with Khanti causing injury on head.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that on account of dispute relating to land, the present false case has been instituted.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that the specific allegation against the petitioner is of causing injury with Tangi on head of the informant and the injury is said to be grievous.
6. Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.
7. Accordingly, the present anticipatory bail application stands rejected.
