The petitioners Rana Singh and Samar Pratap Singh @ Tuntun Singh apprehend their arrest in Muffasil P.S. Case No. 280 of 2014, registered for the offences punishable under Sections 353 and 34 of the Indian Penal Code.
Allegation against the petitioners is that they came on a polling booth and some verbal altercation took place and thereby caused hindrance in smooth polling.
Learned counsel for the petitioners submits that the petitioners did not use any force. Petitioner No. 2 Samar Pratap Singh is a candidate in PACS election and petitioner no. 1 is brother of petitioner no. 2.
Learned APP did not dispute the facts.
Patna High Court Cr.Misc. No.51909 of 2014 (2) dt.06-01-2015 It appears that the petitioners did not use any force only some verbal altercation had taken place, considering this, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P.S. Case No. 280 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
