The petitioner seeks bail in connection with Siwan Town P.S. Case No. 549 of 2018 registered under Sections 413, 414/34 of the Indian Penal Code.

Stolen Scorpio vehicle is said to have been seized from the possession of the accused Vishal Kumar Patel and the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has no concern with the aforesaid occurrence. Actually, the vehicle in question, was seized from the possession of co-accused, namely, Vishal Kumar Patel as evident from the seizure list, but the

No.78848 of 2018(3) dt.15-02-2019 2/2 petitioner has been falsely implicated in this case by the police apprehending him from his house and also seized his mobile phone and later on obtained his signature on the seizure list which would be evident from the call details record (CDR) of his mobile phone at the instance of his enemy. Though, one more case under Section 379 I.P.C. has been lodged against the petitioner, but he is on bail in the said case. The petitioner has been languishing in custody since 31.08.2018. On the other hand, learned APP opposed the bail prayer of the petitioner.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan Town P.S. Case No. 549 of 2018.
