JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-03-2015 Having perused I.A.No. 1872 of 2015, this Court , prima facie, is satisfied that the Secretary, Dental Council of India is in gross contempt.
This Court in the writ proceeding and subsequent disposal of the M.J.C. application clearly held that once the State had granted essentiality certificate in respect of the petitionerinstitution, which the petitioner had already submitted to the Dental Council of India, on basis whereof the inspection was conducted, then asking the institution to once again go to the State
Patna High Court CWJC No.346 of 2015 (3) dt.11-03-2015 2 / 2 Government and get a fresh essentiality certificate, was not a requirement in law or in fact. Notwithstanding the aforesaid, the Dental Council of India, in defiance to the order of this Court, has directed the Government of India to permit the institution to start M.D.S. course subject to the institution furnishing fresh essentiality certificate.
Let the Secretary, Dental Council of India personally present to answer the rule of contempt on 13th March, 2015, at 2.15 P.M. This case would be listed before this Court notwithstanding any other matter already fixed before this Court. (Navaniti Prasad Singh, J) B.Roy/- U
