The petitioner is in custody in connection with Special POCSO Act Case No. 55 of 2022 arising out of Salkhua P.S. Case No. 148 of 2021 for the offences under Sections 363, 366A, 376 of the Indian Penal Code and Section 4 and 6 of POCSO Act as well as Section 9 of Prohibition of Child Marriage Act.
Learned counsel for the petitioner submits that the petitioner has got eight criminal antecedents and he is in custody since 02.06.2022.
As per F.I.R, all accused persons armed with dangerous weapons forcibly kidnapped informant's minor daughter aged about 16 years and fled away after firing and threatening the prosecution side. It has been further alleged that
Patna High Court CR. MISC. No.24097 of 2023(2) dt.18-05-2023 2/2 the petitioner kidnapped the minor daughter of the informant with intent to solemnize unlawful marriage. Admittedly the victim is minor who has got married to the accused. The victim girl has been recovered and she in her statement recorded under Section 164 of Cr. P.C has stated that she got married with the petitioner without any force. Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judge-VIcum- Special Judge, POCSO Act, Saharsa in connection with Special POCSO Act Case No. 55 of 2022 arising out of Salkhua P.S. Case No. 148 of 2021.
