The petitioners Pappu Yadav @ Jairam Kumar, Shrawan Yadav and Sanoj Yadav apprehend their arrest in a case registered under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act in connection with Parbatta P.S. Case No. 219 of 2014.

Sunita Devi the informant made allegation that the petitioners came and made indiscriminate firing. The informant received injuries on her shoulder.

Learned counsel for the petitioners submits that the petitioners are agnates of the informant. The injuries are simple in nature and the case has already been compromised. Learned APP did not dispute the facts.

Patna High Court Cr.Misc. No.51898 of 2014 (2) dt.05-01-2015 There appears that there is very specific allegation that the petitioners made indiscriminate firing in which the informant received two injuries caused by firearm although the injuries are simple in nature.

Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, their prayer for anticipatory bail is rejected. However, the petitioners, if so advised, may surrender before the court below within four weeks and the court below shall consider the prayer for bail of the petitioners without being prejudiced by this order.
