JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 09-11-2020 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 304(B), 201(B/34 of the Indian Penal Code.

Allegation against the petitioner is of killing the victim due to non-fulfillment of demand of the dowry. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner is in jail custody since 11.12.2019 and has got no criminal antecedent. He further submits that the matter has compromised between the parties.

Learned APP for the State opposes the prayer for bail petition.

No.23715 of 2020(4) dt.09-11-2020 2/2 Considering the aforesaid facts and circumstances of the case, petitioner is the husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Kesariya P.S. Case No. 314/2019 pending in the Court of learned C.J.M., Motihari, East Champaran.

Accordingly, this application is dismissed.
