The petitioner apprehends his arrest in connection with Bhaptiahi P.S.Case No. 67 of 2016 instituted under Section 7 of the Essential Commodities Act.
The allegation, in brief, is that a pick-up van with 100 bags of rice was apprehended by the Block Supply Officer and it is alleged that the said rice was lifted from the P.D.S. Shop of the petitioner to sell in the black market.
Learned counsel for the petitioner submits that there is no material to connect the petitioner with the seized rice as it was not seized from the P.D.S. Shop of the petitioner. He further submits that the petitioner has submitted the food grains register and stock register to the authorities concerned for verification and

Considering the facts and circumstances of the case, let the petitioner, namely, Ram Narayan Yadav, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Bhaptiahi P.S.Case No. 67 of 2016 , subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
