The petitioner is languishing in custody for the offences punishable under Sections 147/148/149 /341/ 302 / 504/506 of the Indian Penal Code in connection with S.T. No.539 of 2018, arising out of Andar P.S. Case No. 116 of 2018. The petitioner allegedly caused multiple dagger blow to the deceased.
Submission is that the land dispute is the reason behind the false implication. The petitioner is in custody since 04.07.2018.
Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail for the present. Hence, the prayer for bail is refused. The trial Court is directed to expedite the trial
Patna High Court CR. MISC. No.20518 of 2019(3) dt.10-06-2019 2/2 and conclude the same preferably within nine months, failing which the petitioner would be at liberty to renew the prayer for bail before the trial judge itself.
