The petitioners apprehend their arrest in connection with Nayagaon P. S. Case No. 95 of 2016 instituted under Sections 341, 323, 307 and 427/34 of the Indian Penal Code. The allegation, in brief, is that there was land dispute and on account of that petitioner no. 1 has hit the motorcycle of the husband of the informant by car, due to which he suffered injury on elbow of the right and left hand and on the back, as a result he fell down from the motorcycle. Petitioner no. 1 also opened fire from the country made pistol but the husband of the informant fled away and the petitioner no. 2, the brother of the petitioner no. 1, was also in the car.

No.6524 of 2017 (2) dt.10-02-2017 2/2 It is submitted that due to land dispute such false allegation has been levelled against the petitioner and no injury was caused to the husband of the informant and except two simple case under Section 379/34 of the Indian Penal Code lodged by the co-villager due to enmity there is no criminal antecedent of petitioners. Moreover, there is no allegation against the petitioner no. 2.

Having considered the aforesaid facts and circumstances, let the petitioners, namely Vikash Kumar Singh and Rahul Kumar Singh, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Saran at Chapra in connection with Nayagaon P.S.Case No. 95 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
