The petitioners seek regular bail in connection with Banka PS case no. 411 of 2018 registered for the offence punishable under Sections 341, 342, 323, 326, 326(A), 307/34 of Indian Penal Code.
The allegation is regarding the petitioners and other co-accused persons having assaulted the informant and others. The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case and the injury inflicted upon the informant side has been found to be simple in nature, however subject to further opinion to be

It is further submitted that the present FIR arises out of a family dispute and the petitioners are not having any criminal antecedent. Lastly, it is submitted that the petitioners are languishing in custody since 15.06.2018 i.e. for about six months, hence have been adequately punished. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail.
Accordingly, the abovenamed petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Banka PS case no. 411 of 2018.
