JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-02-2017 Heard Mr. Paswan in support of the present application seeking modification in the order dated 19.12.2016 passed in Cr. Misc. No. 47914 of 2016 whereby the petitioner was granted the privilege of anticipatory bail on condition that he shall deposit a sum of Rs. 1, 50,000/- in favour of the informant and surrender within 04 weeks.
No one appears on behalf of the State.
Referring to Annexure-1, it is stated that a demand draft in the sum of Rs. 1, 50,000/- favouring the informant was prepared on 12.01.2017, but owing to his illness he could not take further steps. In the circumstances, a prayer has been made for extension of time.
Considering the statements made in the application and submission made in support thereof, I am inclined to allow this application. The order dated 19.12.2016 is modified to the extent
Patna High Court Cr.Misc. No.7005 of 2017 (2) dt.22-02-2017 2/2 that the petitioner shall surrender as per the said order on or before 22.03.2017 whereafter he shall be released on anticipatory if the condition spelt out in the order dated 19.12.2016 is complied with by him to the satisfaction of the learned court below.
