The petitioners apprehend their arrest in connection with Vaishali (Belsar OP) P.S. Case No. 17 of 2018, registered under Section 304(B) of the Indian Penal Code, pending in the court of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
The accusation is of killing of daughter of the informant due to non-fulfillment of demand of motorcycle by her brother-in-laws, namely, Dhiraj Kumar and Sudhir Kumar (petitioners).
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.19812 of 2019(5) dt.01-08-2019 2/2 petitioners submits that it would appear from the F.I.R. that informant has not disclosed the name of her son-in-law in the F.I.R. and she made complaint against petitioners, who are brother-in-law, for committing the murder of her daughter. Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
