ANJANA MISHRA ORAL ORDER 08-03-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is the husband, who is in custody since 30.10.2017 in connection with Bakhri P.S. Case No.219 of 2017, G.R. No.3116 of 2017 registered for the offence under Section 304B of the I.P.C., which is pending in the court of the learned ACJM-V, Begusarai.

The prayer for bail of the petitioner was earlier rejected vide order dated 20.07.2018 passed in Cr.Misc. No.42610 of 2018.

In view of the fact that the death had occurred within seven years of the marriage, the petitioner has again renewed his prayer for bail stating that in view of the period of custody, the petitioner may be extended the privilege of bail.

No.72025 of 2018(4) dt.08-03-2019 2/2 However, after going through the entire facts and circumstances of the case and on account of the fact that there was clear indication that the petitioner was involved in the occurrence, I am not inclined to allow the prayer for bail to the petitioner. It is, accordingly, rejected.

The trial court has, however, sent the report stating that the charge has already been framed.

Let the trial of the case proceed on day to day basis without granting any unnecessary adjournment so that the same may be concluded positively within a period of six months from today.
