JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. It is alleged against the petitioners that they assaulted the informant with lathi, danda and Khanti and when the informant's brother came to rescue, he was also assaulted. It is submitted by learned counsel for the petitioners that the injuries of the informant and his brother were found to be simple in nature which has been brought on record as Annexure-3 (series). Petitioner no.1 also filed a case before the Gram Kachahari against the informant. The petitioners are the agnates of the informant. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

No.52081 of 2014 (2) dt.06-01-2015 2/2 Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., Bhagalpur in connection with Kahalgaon P.S. Case No. 476 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
