Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is a case of misuse of privilege of bail. Misuse was committed on 20.11.2015 and thereafter the petitioner is in custody since 17.09.2019.

It is stated that though charges were framed on 24.11.2014, no prosecution witnesses turned up till 20.04.2015. Thereafter petitioner had gone to earn his livelihood. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.26116 of 2020(2) dt.12-10-2020 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Pupri P.S. Case No.75 of 2014, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
