The petitioner Ramesh Paswan apprehends his arrest in Complaint Case No. 414 of 2011, registered for the offences punishable under Sections 498A and 380 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. The wife made allegation that after marriage, her husband began to demanding a she buffalo and Rs. 30,000/- and due to non-fulfillment of demand of dowry her husband subjected to her physical and mental torture and ultimately drove her out from the house.
Learned counsel for the petitioner submits that the petitioner is ready to keep his wife and on some domestic petty dispute the wife has filed this case.
Patna High Court Cr.Misc. No.1101 of 2015 (2) dt.12-01-2015 Considering the facts aforesaid, the petitioner is directed to surrender before the court below and the court below i.e. learned Sub-Divisional Judicial Magistrate, Daudnagar will enlarge the petitioner provisionally for one month on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar in connection with Complaint Case No. 414 of 2011.
The dispute between the husband and the wife is resolved the provisional bail of the petitioner shall be confirm, if the dispute between the husband and the wife is not resolved the court below shall pass order in accordance with law on its own merit.
