JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Forest Case No. 64 of 2016, registered under Sections 33, 41, 42, 52 and 64 of the Forest Act, Sections 29 and 51 of the Wild Life Protection Act and Sections 25(1-b)a and 26 of the Arms Act. The accusation is that petitioner and three others were seen in the forest area by the officials of Forest Department. While three succeeded to flee away but this petitioner was apprehended with gun, which is said to be used for killing of animals and 'birds'. Pieces of word were also recovered from there. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.9741 of 2017 (2) dt.16-03-2017 petitioner has falsely been implicated in this case mere on suspicion and he is in custody since 24.08.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Forest Case No. 64 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
