The matter has been taken up through video conferencing.

The petitioner seeks bail in Sahebpur Kamal P.S. case No. 101/2018 registered u/s 420, 467, 468, 414, 120(B)/34 of the IPC and u/s 30(a) of the Bihar Prohibition & Excise Act. The petitioner is the driver of the truck and from the truck 4208 liters of liquor of different brands was recovered. The learned counsel for the petitioner submits that petitioner is in custody since 22.04.2018. The petitioner has already remained in jail for more than two and half years but the trial has not yet been concluded.

A report from the trial court was called for and from

Patna High Court CR. MISC. No.24722 of 2020(3) dt.02-12-2020 2/2 the report it appears that only five witnesses were examined and four charge sheet witnesses are yet to be examined. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner has remained in jail fore more than two and half months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 50,000/- (rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Sahebpur Kamal P.S. case No.101/2018, subject to condition that one of the bailors shall be a Government servant and another bailor shall be local having sufficient immovable property within the jurisdiction of the court.
