JUSTICE SANJAY PRIYA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends her arrest in Chandi P.S. Case No. 129 of 2016 instituted for the offence under sections 406 , 420 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

It is alleged in the written report that informant negotiated for settlement of marriage of her daughter Neha Kumari with son of this petitioner namely, Chintu Kumar but ultimately marriage could not be performed because of reason as mentioned in the FIR.

It has been submitted that Chintu Kumar and other accused have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 22.12.2016 passed

Patna High Court Cr.Misc. No.12969 of 2017 (2) dt.23-03-2017 2/2 in Cr. Misc. No. 54950 of 2016.

This petitioner is mother of Chintu Kumar.

As per written report, there is no any specific allegation of overt act against her.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Chandi P.S. Case No. 129 of 2016, she shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Rashmi Prasad, Judicial Magistrate 1st Class, Hilsa (Nalanda), subject to the conditions as laid down under Section 438(2) Cr.P.C. (Sanjay Priya, J) Ravi/- U T
