2. The petitioner seeks bail in connection with Kusheshwar Asthan P.S. Case No. 04 of 2026 registered for the offence punishable under Sections 137(2), 96 and 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, the petitioner is said to have kidnapped the minor daughter of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 13.01.2026 having clean antecedent.
5. Learned APP appearing for the State opposes the
Patna High Court CR. MISC. No. 22198 of 2026(2) dt.09-04-2026 2/2 prayer for regular bail of the petitioner.
6. From the statement of the victim girl recorded under Section 183 BNSS, the victim has denied the prosecution case.
7. Considering the statement of the victim girl and the clean antecedent of the petitioner, this application is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Biraul, Darbhanga/ concerned Court in connection with Kusheshwar Asthan P.S. Case No. 04 of 2026.
9. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
