The petitioner apprehends his arrest in Rajoun P.S. Case No.105 of 2018 registered under Sections 366, 379 and 34 of the Indian Penal Code.

The husband of the victim made allegation that the petitioner became friend of his wife on Facebook and kidnapped his wife with ornaments and other articles.

The learned counsel for the petitioner submits that the victim returned to her house and made statement under Section 164 Cr.P.C. The victim disclosed that her husband and in-laws were subjecting her to physical and mental torture on account of which, she fled away and went to Delhi. The victim did not allege any role of the petitioner in her leaving the house and remaining outside the house for many days.

No.74935 of 2018(2) dt.20-12-2018 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No.105 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
