Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State, through video conferencing.

The petitioner seeks regular bail in connection with Ara Mufassil Police Station Case No. 133 of 2020, registered for the offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that the police recovered 120 litres of illicit foreign liquor from the mango orchard of co-accused Vishal Singh.

Patna High Court CR. MISC. No.20822 of 2020(2) dt.23-06-2020 2/2 Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has got no criminal antecedent. He submits that the petitioner is a labourer and at the time of raid, he was working in the mango orchard of co-accused Vishal Singh. He further submits that no illicit liquor has been recovered from the conscious possession or the premise belonging to the petitioner. After having heard learned Counsel for the parties and taking into consideration the facts that the petitioner has got no criminal antecedent and illicit liquor has been recovered from the mango orchard of co-accused Vishal Singh, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge -cumSpecial Judge, Excise, Bhojpur, at Ara, in connection with Ara Mufassil Police Station Case No. 133 of 2020.
