The present writ application has been filed challenging the legality of the order dated 10.11. 2010 (Annexure-12) whereby the deputation of the petitioner in the office of the Civil Surgeon was recalled and he was placed to his original cadre in Primary Health Centre.
A counter affidavit has been filed on behalf of respondent no.4 justifying the aforesaid order which, according to the respondents, is not punitive inasmuch as a deputationist has no right to continue on deputation.
Be that as it may, since nobody appears on behalf of the petitioner, this Court is left with no option but to dismiss the application for non-prosecution. I order accordingly. (Kishore Kumar Mandal, J) HR/- U
