JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kahalgaon P.S. Case No. 739 of 2018 for the offence under Sections 401, 419, 420, 414, 467, 471, 386, 384 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act. In the F.I.R., it is alleged that the petitioner was involved in illegal recovery from the drivers of the truck and tractor coming from N.H.80 between Pirpainti to Kahalgaon. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 14.12.2018.

Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than 31⁄2 months, the petitioner, named above, is directed to be
