This application for regular bail arises in connection with Parasbigha P.S. Case No. 58 of 2020, disclosing offences punishable under Section 420 of the Indian Penal Code, Section 7 of Essential Commodities Act and Section 53 of the Disaster Management Act.
The petitioner is a PDS dealer. It has been alleged in the written statement of the Supply Inspector, who is the informant that he had noticed commotion at the petitioner's PDS shop and from the consumers present there, he learnt that the petitioner was releasing less than the approved quantity and was overcharging for the commodities, which was supplied to the consumers. Despite note of caution given to the petitioner, the
Patna High Court CR. MISC. No.20931 of 2020(2) dt.24-06-2020 2/2 consumers complained of similar misconduct by the petitioner in dealing with the supply of essential commodities. The petitioner is in custody since 28.04.2020.
Considering the facts and circumstances and nature of accusation, this application is allowed.
Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount to the satisfaction of the learned C.J.M. Jehanabad in connection with Parasbigha P.S. Case No. 58 of 2020.
