JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 406/420 of the Indian Penal Code.

Allegation against the petitioner is that he purchased diesel from the petrol pump of Ma Janaki Petrol Pumb worth Rs.62,000/- for distribution and for use of different mobile towers but the petitioner misappropriated the same. Submission is that present false case was lodged as the petitioner was demanding his due wages. Petitioner is in custody since 12.08.2016.

Considering the aforesaid facts, let petitioner,

Patna High Court Cr.Misc. No.50480 of 2016 (2) dt.22-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Vaishali at Hajipur/Successor Court, in connection with Bhagwanpur P.S. Case No.70 of 2015.
