JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-188/308/272/273 of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.

One country-made Katta and one dagger are said to have been recovered from conscious possession of the petitioner, whereas; 20 litres country-made liquor and other articles are said to have been recovered from possession of companion of the petitioner.

Submission on behalf of petitioner is that co-accused has already been granted privilege of bail by this court and as a matter of fact, the petitioner has falsely been implicated in this case and is languishing in jail custody since 06-08-2016 without

Patna High Court Cr.Misc. No.46486 of 2016 (2) dt.24-10-2016 2/2 having any criminal antecedent.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Marhowrah P.S. Case No. 377 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Saran at Chapra. (Hemant Kumar Srivastava, J) A.K.V./- U T
