====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 27-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Buxar (M) P.S. Case No. 389 of 2021 lodged under Section 414 of the Indian Penal Code read with Section 25(1-B)a, 26 and 35 of Arms Act and Sections 20(b), 22(1) and 29 of Narcotic Drugs and Psychotropic Substances Act.

As per the prosecution story, on secret information, police has made raid on which the petitioner alongwith other two persons were arrested. One mobile has been recovered from the possession of the petitioner, one pistol and life cartridges were recovered from the possession of Vishal, whereas 5.184 kg. Ganja has been recovered from the possession of Santosh. Learned counsel for the petitioner submits that one

Petitioner is in custody since 22.10.2021 having clean antecedent. He further submits that co-accused from whose possession arms has been recovered, has already been granted bail by the Co-ordinate Bench of this Court vide order dated 28.04.2022 passed in Cr. Misc. No. 2176 of 2022. Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances and the submissions made above that the petitioner is in custody since about 8 months, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Court of N.D.P.S. Act, Buxar in connection with Buxar (M) P.S. Case No. 389 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

One of the bailors shall be the close relative of the petitioner.
