The petitioner seeks bail in Rajpur P.S. Case No. 180/2018, instituted for the offences under Sections 399, 402, 414 of the Indian Penal Code read with Sections 25(1-b)a, 26 and 35 of Arms Act.
It is alleged in the written report that on getting secret information police party reached near Bartali Bridge on SarenjaSikroul Road and apprehended two miscreants along with one white colour car. Four miscreants managed to run away. The apprehended persons disclosed their name as Ajit Sah and the petitioner. From possession of this petitioner 12 live cartridges have been recovered. It is further alleged that on confession of this petitioner and other co-accused, police raided the Garage of
Patna High Court Cr.Misc. No.68955 of 2018(2) dt.30-11-2018 2/2 Vikash Kumar Maurya and recovered one looted motorcycle. Learned counsel for the petitioner has submitted that police has arrested this petitioner along with other accused persons merely on suspicion that they were planning to commit crime. Petitioner is in custody since 07.08.2018. Considering the period of custody already spent by the petitioner, the prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Rajpur P.S. Case No. 180/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
