Petitioner is said to have opened fire causing fire arm injury on the leg of the informant but Annexure-3, the photostat copy of the injury report of the informant goes to show that cut and swelling wound was found on the leg of the informant and doctor opined that the aforesaid injury was caused by hard and blunt substance. Moreover, it appears from perusal of the First Information Report that the alleged occurrence took place on account of land dispute and furthermore it is obvious from the record that there is case and counter case between the parties and it appears that persons from both the sides sustained injuries. Petitioner is in jail custody since 21.09.2016 and does not have any criminal antecedent.

Patna High Court Cr.Misc.
