JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-11-2015 Learned counsel for the petitioners is permitted to make necessary correction in the petition, as prayed for. Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323 and 307 of the Indian Penal Code. The prosecution case is that the accused persons including the petitioners assaulted the father and brother of the informant. When the informant took them to hospital, the accused persons made assault to the father of the informant.

No.43885 of 2015 (2) dt.02-11-2015 2/2 It is submitted by the learned counsel for the petitioners that the injury of brother and father of the informant have been found to be simple and there is counter version of the occurrence where the petitioners side also received injury. The petitioners are accused in one other case apart from the present one. Learned counsel for the informant submits that the accusation of assault is specific. However, he is not controverting the nature of injury received by the informant side. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No.431 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
