JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 47(a) (g) and 57(1) of Bihar Excise (Amendment) Act, 2016.

Earlier the prayer for bail of the petitioner was rejected by this court but submission on behalf of the petitioner is that petitioner is in jail custody since 22.04.2016 and he has sufficiently been punished for the alleged occurrence. It is further submitted that according to prosecution case itself, the seized liquor belongs to Varun Yadav, who has already been granted privilege of anticipatory bail by a co-ordinate Bench of this court.

Patna High Court Cr.Misc. No.45708 of 2016 (2) dt.09-11-2016 2/2 It is further submitted that petitioner does not have any criminal antecedent and his only fault is that on the request of co-accused, Varun Yadav, he permitted him to store the liquor in the house of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Gaya in connection with Magadh Medical P.S. Case No. 86 of 2016.
