JUSTICE SANJAY PRIYA ORAL ORDER 27-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Siswan (Chainpur O.P.) P.S. Case No. 159 of 2016 instituted for the offence under Section 7 of the Essential Commodities Act. It is alleged that on confidential information one Tata 407 vehicle loaded with 140 bags of rice having marked with FCI was intercepted by the informant. The owner and the driver of the vehicle were apprehended and one person managed to flee away. It is alleged that the owner of the vehicle disclosed that Mantu Singh told him to get loaded the rice from SFC godown of MDM and the same was being carried by him. The informant made enquiry along with the Assistant Godown Manager and learnt that on 18.10.2016 two tractors loaded with rice were sent from his godown. It is alleged that the petitioner in conspiracy with Mantu

Patna High Court Cr.Misc. No.8196 of 2017 (2) dt.27-02-2017 2/2 Singh were carrying the rice for black-marketing. From the written report itself it appears that the petitioner was not apprehended on spot rather his name has been disclosed by the co-accused persons namely, Ranjit Kumar and Ajit Kumar.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Siswan (Chainpur O.P.) P.S. Case No. 159 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sandeep Kumar, learned Judicial Magistrate, Siwan, subject to the conditions as laid down under Section 438 (2) Cr.
