The Petitioner apprehends his arrest in Bodhgaya P.S. Case No. 20 of 2017 registered for the offence punishable under Section 7 of the E.C. Act.

It has been alleged in the FIR that the raid was conducted by the Block Supply Officer, Bodhgaya on 07.12.2016 in the PDS Shop of the petitioner and found shortage of 30 quintals of rice and 29 quintals of wheat in place of 65.47 quintals of rice and 43.58 quintals of wheat. It has been further alleged that subsequently show cause was issued by the licensing authority i.e. S.D.O. Sadar, Gaya, but the petitioner did not file any reply and therefore, it was presumed that he has sold the rice

Patna High Court Cr.Misc. No.22199 of 2017 (2) dt.29-05-2017 2/2 and wheat in the black market. Subsequently, the petitioner has filed his show cause before the S.D.O. Sadar, Gaya, in which he has given details of distribution of rice and wheat amongst the card holders.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S. Case No. 20 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
