1. The instant appeal was preferred by the sole appellant against the judgment dated 30.10.2004 and order dated 1.11.2004 passed in Sessions Trial no.66 of 2002/371 of 2002 by the learned 8th Additional Sessions Judge, Gaya whereby the appellant was convicted under section 376 of Indian Penal Code and sentenced to undergo R.I. for 10 years and to pay a fine of Rs.10,000/-.
2. By order dated 20.9.2025, a report was called for from the Superintendent of Police, Gaya as to whether the appellant is dead or alive.
3. The report contained in Letter no.1172 dated 5.10.2025 has been received from the Senior Superintendent of Police, Gaya wherein on the basis of the enquiry conducted by the Officer Incharge of the Buniyadganj Police Station in the
Patna High Court CR. APP (SJ) No.828 of 2004(5) dt.06-12-2025 2/2 district of Gaya it has been stated by the Senior Superintendent of Police, Gaya that the appellant has died.
4. In view of the above, the sole appellant having died during pendency of the instant appeal, the appeal stands disposed of as having abated.
