Earlier, the prayer for bail of the petitioner was rejected by this Court taking note of this fact that 10 liters country made liquor was recovered from conscious possession of the petitioner but submission on behalf of the petitioner is that he is in jail custody since 13.04.2016 and the Bihar Excise (Amendment) Act 2016 has been declared ultra vires by a Division Bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Katihar in connection with Korha
