JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in connection with Mahila P.S. Case No. 45 of 2016 registered under Sections 323, 376, 498(A)/34 of the Indian Penal Code and Section 4 of the Dowry Probition Act.
Allegation, in brief, is that the informant's husband died in road accident, thereafter the in-laws assured her to marry her with their younger son, Azad who started living with the informant in live in relation and made sexual contact also and denied to marry with her and father-in-law and mother-in-law insisted for dowry of Rs. 2 lacs to get her married with Azad their younger son. Azad is not the petitioner in this anticipatory bail petition. The petitioners are father-in-law, mother-in-law and brother of the husband of the informant and their wives and it was submitted that no demand of dowry was made by these petitioners.

Having considered the aforesaid facts and circumstances Azad, so the petitioners, namely, Ravindra Vishwakarma, Kishori Vishwakarma, Munti Devi, Sarita Devi, Munni Devi and Anandi Vishwakarma, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Lakhisarai in connection with Mahila P.S. Case No. 45 of 2016 , subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arun Kumar, J) BTiwary/- U T
