Mr. Binod Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-07-2023 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bihra P.S. Case No. 193 of 2019 corresponding to Sessions Trial No. 199 of 2021 registered for the offence under Sections-302, 120B, 34, 307 of the Indian Penal Code and 27 of the Arms Act.

Earlier prayer for bail of the petitioner was rejected taking into account that the petitioner is named in the FIR and there is allegation of indiscriminate firing against the accused persons including the petitioner. The postmortem report shows that there are multiple fire-arm injuries on the body of the deceased. The petitioner is said to be one of the assailants. A report was called for from the trial court. It has been reported that all the witnesses have already been examined and the case is fixed for argument.

Considering the nature of accusation and stage of the case, I am not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. The trial court is directed to conclude the trial within a period of one month from the date of receipt/production of copy of this order.
