JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Bihiya P. S. Case No. 236 of 2014 registered under Sections 408, 409, 420, 120 B/34 of the Indian Penal Code.

It is contended that several co-accused persons having identical allegation, have already been granted anticipatory bail by a Bench of this Court, vide order dated 26.06.2015 passed in Cr. Misc. No. 51739 of 2014 and analogous cases.

Learned counsel for the State concedes that the case of the petitioner is identical to that of other co-accused persons, who have already been granted bail under Section 438 of the Code of Criminal Procedure by this Court.

Patna High Court Cr.Misc. No.43394 of 2015 (2) dt.13-10-2015 2/2 Regard being had to the reasons assigned in the aforesaid order dated 26.6.2015 passed in Cr. Misc. No. 51739 of 2014 and analogous cases, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara, Bhojpur in Bihiya P. S. Case No. 236 of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
