JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Two persons were killed and their dead bodies were recovered at two different places. Thereafter, two separate cases were registered. In Chandauti P.S. Case No. 203 of 2004, one coaccused Dileep Kumar Dubey was arrested and made his confessional statement in that case, leading to recovery of looted iron steel and subsequently, the aforesaid Dileep Kumar Dubey disclosed the name of petitioner and his other associates. On the basis of aforesaid confessional statement, the petitioner was remanded in Chandauti P.S. Case No. 203 of 2004 as well as in the present case. Petitioner has already been granted privilege of bail in Chandauti P.S. Case No. 203 of 2004 and in the present

Patna High Court Cr.Misc. No.47415 of 2016 (3) dt.16-01-2017 2/2 case also, except the confessional statement of co-accused, Dileep Kumar Dubey, there appears to be nothing against him. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sherghati P.S. Case No. 178 of 2004 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya.
