====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 27-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Shastri Nagar P.S. Case No. 591 of 2021 lodged under Sections 25(1-B)a, 26 and 35 of the Arms Act.
As per the prosecution, police has made raid getting information that 3-4 criminals are distributing stolen property in the old house near Durga Asthan Gali, when police reached the accused persons, they started fleeing from the spot. The petitioner was caught raid handed and from his possession loaded pistol and a bag in which stolen articles are there, recovered.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.22747 of 2022(2) dt.27-07-2022 2/3 petitioner is a poor person and he is in custody since 30.11.2021. He further submits that charge sheet has already been filed in this case. He further submits that there is one criminal antecedent, in which he is on bail. Learned counsel for the petitioner specifically mentioned that petitioner is in custody since last about 8 months and he has two child and no one is there to look after them.
Learned counsel for the State opposes the prayer for bail.
Considering the facts and circumstances and the submissions made above that the petitioner is in custody since about 8 months, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Patna in connection with Shastri Nagar P.S. Case No. 591 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
One of the bailors shall be the close relative of the petitioner, who shall file an affidavit about his relation with the petitioner.
The petitioner is directed to file an affidavit before the Court below at the time of furnishing the bail bonds that he shall
Patna High Court CR. MISC. No.22747 of 2022(2) dt.27-07-2022 3/3 not involve in such type of activities again and also appear before the Trial Court on each and every date, in case of nonappearance for two consecutive dates, shall resulted into cancellation of his bail bonds.
