JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-06-2020 Heard Mr. Praveen Kumar Agrawal , learned counsel for the petitioner and Mr. Brajendra Nath Pandey, learned counsel appearing for the State through video conferencing. Learned counsel for the petitioner is directed to remove the defects within eight weeks.

Petitioner seeks regular bail in connection with Shahkund P.S. Case No. 14 of 2020 registered for the offence punishable under Section 341, 323, 324, 498(A), 434, 504, 506/34 of the I.P.C. and Section 3⁄4 of the Dowry Prohibition Act.

The allegation against the petitioner as per the First

Patna High Court CR. MISC. No.20933 of 2020(2) dt.24-06-2020 2/3 Information Report is that marriage of informant was solemnized with the petitioner in the year 2013. It has further been alleged that after some time petitioner and other family members started torturing the informant physically and ousted her from matrimonial home. It has also been alleged that thereafter petitioner has performed marriage with a lady and informant after getting information about second marriage of the petitioner came to her matrimonial home and asked the petitioner about the same, then the petitioner assaulted the informant by fists and slaps and the brother of the informant by means of butt of Axe.

Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged. Learned counsel further submits that he has not performed second marriage and the allegation of assault is false and fabricated inasmuch no apparent injury has been found on the person of the informant. Learned counsel also submits that petitioner is in custody since 23.01.2020.

Having heard learned counsel for the parties and taking into consideration the fact that there appears to be marriage discord between the parties and petitioner is in custody since 23.01.2020, I am inclined to grant regular bail to the

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M , Bhagalpur in connection with Shahkund P.S. Case No. 14 of 2020.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
