JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,326,307,449,504 and 106 of the Indian Penal Code and sections 25(1-B) a, 26,27 and 35 of the Arms Act.

The prosecution case is that the petitioner and one Shrawan Kumar came on motorcycle and started abusing the informant. On protest being made, co accused Manish Kumar brought rifle from his house and co accused Shrawan Kumar shot fire from the rifle causing injury on the leg of the informant. The firing resorted to by the petitioner from small fire arm hit on the head of the informant.

No.45667 of 2015 (2) dt.04-11-2015 2/2 It is submitted by the learned counsel for the petitioner that the injury report reflects lacerated injuries on the forehead of the informant. On conclusion of investigation the petitioner was not sent up for trial though co accused Shrawan and others were chargesheeted but differing with the final form cognizance has been taken. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Hilsa at Biharsharif (Nalanda) in connection with Aungari (Pir Bigha) P.S. Case No.31 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
